State Attorneys General Are Becoming AI’s First Real Regulators

AIBW analysis: Florida, eight more states and now the FTC are using existing consumer-protection law.

State Attorneys General Are Becoming AI’s First Real Regulators

Florida sued OpenAI and Sam Altman in June, eight states followed on October 14, and the FTC has sent civil subpoenas to OpenAI and Anthropic, Axios reported. California's SB 243 already regulates companion chatbots and lets injured individuals sue. Meanwhile Congress has passed no federal AI law and is out of session until after the November midterms.

Our view is that enforcement under existing law is filling the gap. The tools are blunt: unsafe-product and deception claims rather than AI-specific rules. We have not read the complaints, and OpenAI disputes the allegations, saying it has built age-specific protections.
