CNBC reported on August 3 that the European Commission's enforcement powers over general-purpose AI models have taken effect. The Commission can demand to evaluate models before public release in the region, restrict EU market access, and fine a provider up to 15 million euros or 3% of its annual turnover, whichever is higher.
A lawyer quoted by CNBC notes that refusing an information request, giving misleading answers or blocking a model evaluation is fineable on its own, and that the powers can reach any company offering a general-purpose model in the EU regardless of where it is based.
The practical question is how quickly the AI Office will use them. As of the latest reporting, it had not acted against any covered company, though it can now request information or ask for access to models.
